Criminal Appeals

Were you convicted at trial? That doesn't necessarily mean that's the final judgment. Over 3,000 people have been wrongfully convicted since 1989. The court system gets it wrong more frequently than some people think. But there are ways to try and remedy the wrong. But don't think it will be easy. The appeals process is incredibly complex and difficult. You can't just challenge the guilty verdict generally. Appeals require you to find a specific aspect of the criminal case to challenge. It's impossible to go through all of the different avenues to appeal a case on this page, but a few of the better challenges to appeal in criminal case include:

  1. error to not grant a constitutional challenge motion

  2. error to not grant pre-trail motions

  3. errors in jury selection

  4. errors in opening statement

  5. errors in direct examination

  6. errors in cross examination

  7. errors in closing argument

  8. lack of sufficiency of evidence

  9. Sentencing errors

  10. Plea agreement not honored
