Not A Sufficient Weight Defense

Many of the controlled substance crimes require that the State prove that the possession or sale of controlled substances was more than a minimum amount of weight. This may seem self evident. Why would the State charge a drug crime without having enough of the drug in question? But it happens more often than you think. A former client of mine was being charged with having greater than 0.25 grams of methamphetamine. The field test the officer conducted revealed a weight of 0.30 grams. There was only one problem. The methamphetamine was weighed along with the tinfoil it was found on. Come to find out that the tinfoil weighed .25 grams itself and the methamphetamine only weighed .05 grams. My clients charges were able to go down because of the weight issue. An issue that would not have existed without carefully examining the facts and not taking the State's charges at face value.
