Manufacturing Meth Crime

There are 2 different ways to be charged with manufacturing meth

1. 1st Degree Controlled Substance - Manufacturing

(Minn. Stat. § 152.021 Subd. 2a)

Manufacturing is distinct within the 1st degree controlled substance statute. Every other 1st degree offense has weight requirements for it to be a 1st degree offense. However, manufacturing any amount of methamphetamine is a 1st degree controlled substance crime. 

2. Possession of substances with intent to manufacture

(Minn. Stat. § 152.0262)

The main distinction between this crime with 1st degree controlled substance manufacturing, is that the State does not need to prove that you actually manufactured methamphetamine. This offense involves possessing chemical reagents or precursors to meth with the intent to distribute.
