2nd Degree Manslaughter

There are 5 different ways to be charged with 2nd degree manslaughter.

  1. Culpable Negligence

  2. Hunting Accident

  3. Spring gun, snare, or other trap

  4. Vicious Animal

  5. Neglect or Endangerment of a Child

1. Culpable Negligence

(Minn. Stat. § 609.205(1))

Causing death by the person's culpable negligence whereby the person creates an unreasonable risk, and consciously takes chances of causing death or great bodily harm to another is 2nd degree manslaughter. 

3. Spring Gun, Snare, or Other trap

(Minn. Stat. § 609.205(3))

Causing death by setting a spring gun, pit fall, deadfall, snare, or other like dangerous weapon or device is 2nd degree manslaughter.

5. Neglect or Endangerment of a Child

(Minn. Stat. § 609.205(5))

Causing death by committing or attempting to commit neglect or endangerment of a child, and the conduct does not fit the requirements of murder, is 2nd degree manslaughter. 

2. Hunting Accident

(Minn. Stat. § 609.205(2))

Causing death by shooting another with a firearm or other dangerous weapon as a result of negligently believing the other to be a deer or other animal is 2nd degree manslaughter. 

4. Vicious Animal

(Minn. Stat. § 609.205(4))

Causing death by negligently or intentionally permitting any animal, known by the person to have vicious propensities or to have caused great or substantial bodily harm in the past, to run uncontrolled off the owner's premises, or negligently failing to keep it properly confined is 2nd degree manslaughter.
